Competition Terms And Conditions

Competition Rules:

Duration: The competition will be held from 1st August 2023 to 28th February 2024.
Qualification Criteria: All orders placed with Palian Manufacturing during the competition period will qualify, regardless of
whether the orders have been invoiced or delivered.

Categories for Winning: Agents can compete in two categories to win:

1. Highest Rand Value: This category considers the actual Rand value of all orders placed at Palian Manufacturing
   during the competition period.
2. Most Orders Placed: This category includes all orders placed at Palian Manufacturing during the competition period
   with a value above R40,000 per order.
   * All above order values are orders placed excluding VAT.

Prizes: There will be one prize winner for each category. Each prize includes:

• 2 Flight tickets from the winner’s closest major airport to Cape Town.
• 2 VIP Tickets to the exciting Stormers vs Edinburgh Rugby match at the DHL Stadium on 23rd March 2024 which
  includes: Premium Buffet and hors d’oeuvres, Fully Stocked Premium Open Bar, On-site hospitality car parking
• 2 nights’ accommodation 22nd to 24th March 2024 in a shared room for two people at the luxurious 5-star The
  Twelve Apostles Hotel, Cape Town.
• Daily breakfast at The Twelve Apostles Hotel during the two-night stay.
• Tea by the Sea for two once during your stay
• 3 days car rental from 22nd March 2024 to 24th March 2024.

Terms and Conditions:

1. Any person participating (a “Participant”) in the Competition does so on acceptance of these terms and conditions
   (“Terms and Conditions”).
2. The Competition will run from 1st August 2023 to 28th February 2024 after which time the Competition will
   automatically lapse, and no further entries will be accepted.
3. One prize will be granted in each category. In the event that an individual manages to secure victory in both
   categories, the next deserving participant in line for the “Highest Rand Value” category will be honored with one of
   the prizes. This approach ensures fairness and allows for equitable distribution of rewards among the top achievers.
4. Winners will be contacted within 5 (five) working days of the final results being known.
5. Any Participants with accounts in arrears by the close of the competition period cannot participate in the competition
   and will be automatically disqualified from the competition.
6. Prizes cannot be exchanged for an alternative prize, date, or cash, and no negotiations will be entertained.
7. Palian reserves the right to replace the prize with one of equal or greater value.
8. The Winners also consent to their names being published on Palian Manufacturing’s websites and various social
   media pages of the Promoters.
9. All decisions pertaining to any aspects of the Competition are final and are made at the discretion of Palian. No
   further correspondence will be entered regarding their decision's respective decisions. Neither Palian nor its
   employees will be held responsible or answerable to any Participant for any dispute arising from the Competition or
   prize.
10. The Competition, its prize, and any terms and/or conditions surrounding it may be amended by reasonable
    notification at any time during the Competition. Such altered terms and conditions and/or prize shall become effective
    immediately after being altered or on such date as may be determined by Palian.
11. Participants who, in Palian’s sole determination, act unlawfully, fraudulently, in breach of these Rules, or otherwise
    dishonestly may be disqualified from participating in the Competition and shall not be eligible to receive any prize.
12. The duration of this Competition may also be extended or curtailed at the sole discretion of Palian. If this is the case,
    the Promoters will provide notice via email.
13. The right of admission into the Competition rests solely with Palian.
14. By entering the Competition and/or accepting any prize, the Participants, users, and/or Winners hereby indemnify,
    release, and hold harmless Palian (including their subsidiaries, holding companies, and affiliates), their directors,
    employees, agents, suppliers, and contractors (the “Palian Parties”) from and against any actions, claims, and/or
    liability for injury, loss, damage, expense, claim for damages of any kind resulting in whole or in part, directly or
    indirectly, from participation in the Competition, and/or the use, acceptance, or possession of a prize, and/or
    participation (or non-participation) in a prize-related activity.
15. Notwithstanding the above, nothing in these Terms and Conditions is intended to, or must be understood to,
    unlawfully restrict, limit, or avoid any rights or obligations created for either the Participant or the Promoter in terms of
    the Consumer Protection Act, 68 of 2008 (“CPA”).
16. Any Personal Information will be used in line with the POPIA (Protection of Personal Information Act, 4 of 2013) and will not be disclosed to a third party.
17. These Terms and Conditions shall be governed by the laws of the Republic of South Africa. In the event of a dispute in connection to this Competition Terms and Conditions, the parties submit to the nonexclusive jurisdiction of the courts in South Africa.
18. Palian or a supplier of goods or services in connection with this Competition is not responsible for any errors, omissions, and/or technical failures of any nature whatsoever throughout this Competition.
19. Winners must be able to travel from 22 nd March 2024 to 24th March 2024 to make use of their prize.
